Mu'adh bin Jabal, Abu Ubaidah bin Jararah, Ubadah bin Samit and Shaddad bin Aws narrated that the Messenger of Allah (ﷺ) said: “If a woman kills someone deliberately, she should not be killed until she delivers what is in her womb, if she is pregnant, and until the child's sponsorship is guaranteed. And if a woman commits illegal sex, she should not be stoned until she delivers what is in her womb and until her child's sponsorship is guaranteed.”
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، ‏‏‏‏‏‏حَدَّثَنَا أَبُو صَالِحٍ، ‏‏‏‏‏‏عَنِ ابْنِ لَهِيعَةَ، ‏‏‏‏‏‏عَنِ ابْنِ أَنْعُمَ، ‏‏‏‏‏‏عَنْ عُبَادَةَ بْنِ نُسَيٍّ، ‏‏‏‏‏‏عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، ‏‏‏‏‏‏حَدَّثَنَا مُعَاذُ بْنُ جَبَلٍ، ‏‏‏‏‏‏ وَأَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ، ‏‏‏‏‏‏ وَعُبَادَةُ بْنُ الصَّامِتِ، ‏‏‏‏‏‏ وَشَدَّادُ بْنُ أَوْسٍ، ‏‏‏‏‏‏أن رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:‏‏‏‏ الْمَرْأَةُ إِذَا قَتَلَتْ عَمْدًا لَا تُقْتَلُ حَتَّى تَضَعَ مَا فِي بَطْنِهَا إِنْ كَانَتْ حَامِلًا، ‏‏‏‏‏‏وَحَتَّى تُكَفِّلَ وَلَدَهَا، ‏‏‏‏‏‏وَإِنْ زَنَتْ لَمْ تُرْجَمْ حَتَّى تَضَعَ مَا فِي بَطْنِهَا وَحَتَّى تُكَفِّلَ وَلَدَهَا .
معاذ بن جبل، عبیدہ بن جراح، عبادہ بن صامت اور شداد بن اوس رضی اللہ عنہم بیان کرتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: عورت جب جان بوجھ کر قتل کا ارتکاب کرے اور وہ حاملہ ہو، تو اس وقت تک قتل نہیں کی جائے گی جب تک وہ بچہ کو جن نہ دے، اور کسی کو اس کا کفیل نہ بنا دے، اور اگر اس نے زنا کا ارتکاب کیا تو اس وقت تک رجم نہیں کی جائے گی جب تک وہ زچگی ( بچہ کی ولادت ) سے فارغ نہ ہو جائے، اور کسی کو اپنے بچے کا کفیل نہ بنا دے ۱؎۔

It was narrated that Aishah said: “The Messenger of Allah (ﷺ) did not leave behind a Dinar nor a Dirham, nor a sheep, nor a camel, and he did not make a will concerning anything.”

It was narrated from Malik bin Mighwal that Talhah bin Musarrif said: “I said to Abdullah bin Abu Awfa: 'Did the Messenger of Allah (ﷺ) make a will concerning anything?' He said: 'No.' I said: 'How come he told the Muslims to make wills?' He said: 'He enjoined (them to adhere to) the book of Allah (SWT).” Malik said: “Talhah bin Musarrif said: 'Huzail bin Shurahbil said: “Abu Bakr was granted leadership according to the will of Allah's Messenger (ﷺ)?” (Rather) Abu Bakr wished that the found a covenant (in that regard) from Allah's Messenger (ﷺ), so he could fetter his nose with a (camel's) nose ring.”
